I have an employee that has not been performing but has been with the company for a while. We are looking to replace him due to his performance. I have managers looking at possibly providing severance even though it would be for cause. What things should I be concerned about here? Anyone ever run into this?
I am not one to normally call my attorney, but inconsistent severance pay makes me really nervous! I would consult your attorney and ask about the pros and cons of providing severance for this termination for cause if it is not your normal process. It might be just fine, but good to know in advance and make an informed decision.
