We have about 30 sales reps living and working in other states. Despite recent state changes to legalize marijuana, federally it remains illegal from what we have been instructed. Meaning, your company can still remain a drug free workplace and conduct the usual pre-employment testing, for cause testing, etc. so we have just one policy for all employees regardless of state.

We are in several states across the US and we do not have separate policies. We have one handbook with one universal policy that prohibits being under the influence at work. We have a reasonable suspicion process we follow if there is suspicion the employee may be under the influence. Also, we no longer require pre-employment drug testing in any state.
