Invalid Unemployment claims

I have started seeing current employees filing for unemployment during a week of paid vacation or if they resign they file even though there is  not gap in their employment.

 Even though this is illegal, how would you handle this with the employee?  How would you handle the conversation with them? Should we just deny the claim and let the process take over?

I'd appreciate any insight you have on this.

  • Yes, I would deny the claim and let the process be the process. You do have to prove to the state that they were paid, or they resigned etc. From my experience, many times, even despite my evidence, the state is favorable to the employee. Good luck to you!   • I'd fight the claim with the state. If you have a lot of these issues, a TPA for unemployment is very helpful, they can contact ODJFS directly and save you a bunch of time.
