Mental health issues skyrocketed in the workplace during the COVID pandemic. Jeff Shoskin, partner with Frost Brown Todd, will review the legal obligations (FMLA/ADA) and practical realities regarding the recognition, and accommodation, of mental health issues. How do you handle an employee with a documented mental health condition? What if you believe an employee is using a phantom mental health issue to get time off work or to escape certain job duties? Employers (unfortunately) do not have a crystal ball.
Patience (a virtue not necessarily possessed by the C-Suite) and training of supervisors is key. While there are no “cookie-cutter” solutions, there are several best practices to implement which will reduce (not eliminate) the chances that you inadvertently stumble into litigation.
