Jeff Shoskin, a partner with Frost Brown Todd, will review a series of 2023  employee/union friendly NLRB decisions and NLRB General Counsel guidance that should weaken your knees.  

Jeff will discuss recent NLRB decisions that: make it easier to reclassify independent contractors as employees; permit employees to use racial and sexist slurs, profanity, harassing /disruptive words and actions – as long as they arguably are engaging in “protected concerted activity”; and deem handbook policies presumptively unlawful if a reasonable employee (redefined by the NLRB)  COULD  reasonably interpret the policy to have a coercive meaning (e.g., chill Section 7 rights).

Jeff also will review two recent NLRB General Counsel guidance memorandums that eviscerate boilerplate severance agreement language and deem most non-compete agreements unlawful.   You may want to eat your lunch after the presentation.
