FMLA Exhaustion

What do I need to send to employees who have exhausted FMLA?

 All the required forms prior to the leave and designation notice have been provided but I didn't know if there was anything I need to provide once exhausted.  The employee has returned to work but still continues to have medical issues due to pregnancy complications.

  • Hello, it has been my experience that once the FMLA period ends you should offer them ADAAA accommodations to help them through this period and avoid any legal issues.

  • Hi, you will need to conduct what is called "the interactive process" with the employee to determine if you can offer an accommodation.  The accommodation may be a leave of absence or reduced hours. Give her a copy of her job description with the hours of work and the physical requirements and let the doctor respond to what she can and cannot do.

    I hate these issues!
